These Terms & Conditions govern the use of Barry John Acting Studio’s website, services, and special programs including “Junoon Hai Toh Jeet Hai.” By using this site or registering for any course or program, you agree to comply with the following terms.

PART 1 – GENERAL TERMS & CONDITIONS

1. Use of Website

This website is operated by Barry John Acting Studio (BJAS). The terms “We”, “Us”, “Our” refer to BJAS, and “You” refers to the user or visitor of this website.

Accessing this website implies your acceptance of these terms. If you do not agree, please exit immediately.

2. Intellectual Property

All logos, names, graphics, content, and layout are either owned or used under license by BJAS or its affiliates. Unauthorized use, reproduction, or distribution is strictly prohibited.

3. Restrictions

Users may not:

  • Sell, modify, or distribute website content

  • Violate copyright or trademark laws

  • Post defamatory, obscene, or illegal content

4. Security & Acceptable Use

You agree not to:

  • Attempt to access unauthorized areas or data

  • Disrupt or harm the website via malware, spam, or denial-of-service attacks

  • Use the site for unlawful purposes

5. Indemnity

You agree to indemnify BJAS, its directors, employees, and affiliates from any claims or damages arising from your use of the website or violation of these terms.

6. Liability Limitation

BJAS is not liable for:

  • Technical issues

  • Interruption of service

  • Loss of data or revenue

  • Actions by third parties

7. Disclaimer

BJAS provides acting education and exposure but does not guarantee employment, casting, or fame.

8. Governing Law

All legal matters will be governed under Indian law, and the courts of Mumbai, Maharashtra will have exclusive jurisdiction.

PART 2 – “JUNOON HAI TOH JEET HAI” TERMS & CONDITIONS

This Agreement outlines the terms and conditions governing participation in the acting reality show (hereinafter referred to as the “Programme”) organized and produced by Barry John Acting Studio (hereinafter referred to as the “Organizer”).

By submitting an application and paying the registration fee, the applicant (hereinafter referred to as the “Participant”) agrees to the following terms and conditions

1. Application & Registration Fee

  • A non-refundable registration and administrative fee of ₹1,999/- is required to apply for participation in the Programme.

  • Payment of the registration fee does not guarantee selection in the Programme.

  • A maximum of 100 participants will be shortlisted to appear in the Programme episodes.

  • Based on performance and evaluation, 20 participants may be awarded a Full-Time Acting Programme valued at ₹2,36,000/- without additional fees.

  • An additional 20 participants may be awarded a Part-Time Acting Programme valued at ₹67,500/-.

  • The Organizer reserves the right to modify the number of participants or rewards if necessary.

2. Audition & Selection Criteria

  • Participants must submit video auditions, reels, or performance material according to the official submission guidelines.

  • Selection will be based on:

    • Acting talent and performance

    • Jury evaluation

    • Audience engagement (views, likes, shares)

    • Overall suitability for the Programme

  • The Organizer reserves the right to reject any submission that is incomplete, inappropriate, misleading, or does not meet the required standards.

  • Failure to submit required audition material may result in disqualification.

  • No refund or seat confirmation shall be provided if a participant fails to submit the required audition material.

3. Intellectual Property & Content Rights

  • All videos, performances, photos, audio recordings, and other content submitted or recorded during the Programme shall become the exclusive property of the Organizer.

  • The Organizer shall have perpetual, worldwide, royalty-free rights to use, reproduce, edit, broadcast, publish, promote, and distribute such content across any platform, including television, digital media, websites, mobile applications, or social media.

  • Participants waive any claim to royalties, payments, or compensation arising from such usage.
  • The Organizer may use the Participant’s name, likeness, voice, image, and performance for promotional or commercial purposes.

4. Participant Conduct

  • The Organizer shall have the sole authority to determine participant selection, progression, elimination, and winners.

  • Any form of cheating, fraudulent activity, manipulation of votes, or misrepresentation of identity will lead to immediate disqualification.
  • Participants must maintain professional conduct and respect toward judges, mentors, staff, and fellow participants.

5. Limitation of Liability

  • Participation in the Programme is voluntary. The Organizer shall not be liable for any loss, injury, damage, or inconvenience arising from participation.

  • The Organizer shall not be responsible for technical issues, internet failures, platform errors, or third-party service disruptions affecting submissions or participation.
  • The Organizer’s decisions regarding selection, elimination, and results shall be final and binding.

6. Programme Modification or Termination

  • The Organizer reserves the right to modify, suspend, postpone, or cancel the Programme at any time due to unforeseen circumstances, legal requirements, or force majeure events.

  • Participants shall not be entitled to compensation or damages in such cases.

7. Participant Eligibility

  • Participants must be at least 18 years of age, or must submit written parental/guardian consent if below 18.

  • Participants must provide accurate personal information during registration.

8. Data & Privacy

  • By registering, participants consent to the collection and processing of their personal information for the purposes of Programme administration, communication, marketing, and promotional activities.
  • The Organizer will take reasonable steps to protect participant data but shall not be liable for unauthorized third-party access beyond its control.

9. Dispute Resolution

  • Any disputes arising from this Agreement shall first be resolved through mutual discussion and negotiation.

  • If unresolved, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

  • The place of arbitration shall be Mumbai, Maharashtra, India.

  • The jurisdiction for all legal matters shall lie exclusively with the courts of Mumbai, Maharashtra, India.

10. Acknowledgement

By registering and paying the registration fee, the Participant confirms that they have read, understood, and agreed to these Terms and Conditions.
